ALPHA MINER® LIMITED WARRANTY

 

Alpha Miner Ltd. (the “Company”) provides a non-transferable warranty to the purchaser of Alpha Miner hardware equipment (the “Equipment”) purchased from an authorized Alpha Miner retailer and/or reseller. Alpha Miner warrants that the Equipment will be free from defects in material and workmanship for a specified period commencing on the date of shipment from Company’s distribution center or purchase from a retail outlet, whichever is later. The warranty period will vary by specific Equipment, as identified in your user documentation, on the Equipment package, or as listed in the attached listing of Alpha Miner Warranty Periods.

Except where prohibited by applicable local law, this Equipment warranty is limited to the original purchaser and is non-transferable. To exercise your warranty rights, you must present a sales receipt and provide Alpha Miner Equipment serial number information. This warranty provides you with specific rights, and you may have additional rights that vary under local laws.

In general, this warranty means your Alpha Miner hardware Equipment will operate in accordance with published technical specifications, as specified by its datasheet and/or user guide, and in the operating environment for which it was intended.

This version of the warranty applies to Equipment purchased on or after October 26, 2017. For prior versions of the Alpha Miner limited warranty, please contact customer service.

Remedies.

Alpha Miner’s entire liability and your exclusive remedy for any Alpha Miner Equipment that is not operating in accordance with its published technical specifications is at Alpha Miner’s discretion: 1) to repair or replace the Equipment at Alpha Miner’s expense, or 2) to refund the price paid less a usage fee of 20% of the purchase price for each annual period commencing with the date of purchase. This warranty obligation is conditioned upon the hardware being returned to the original place of purchase, or another place as directed by Alpha Miner, at Alpha Miner’s discretion, with the original sales receipt attached. You may be required to pay shipping and handling charges, as well as any applicable tariffs, duties, taxes, or other fees associated with the repair, replacement, or refund, as the case may be. Alpha Miner may, at its discretion, provide new or equivalent-to-new refurbished parts in good working condition, or repair or replace the hardware returned to Alpha Miner.

Any repaired or replacement hardware will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is greater, or for the period of time required by local statute.

Obsolete or Discontinued Products.

Obsolete or discontinued Equipment will be replaced with the same Equipment, if available. If Alpha Miner is unable to replace your obsolete or discontinued Equipment with the same Equipment, Alpha Miner will replace the obsolete or discontinued Equipment, in its sole discretion, with an Equipment having similar function and capacity.

Exclusions.

This warranty does not cover problems or damage resulting from, but not limited to, any of the following:

  • General wear and tear associated with normal use;

  • Any modification, abuse, accident, disassembly, misapplication, or unauthorized repair;

  • Missing, altered, or otherwise unreadable serial number label, manufacturer model or part number label;

  • Any improper operation, including use not in accordance with any supplied Equipment Instructions or misuse of the equipment;

  • Connection of Alpha Miner equipment to any improper voltage supply;

  • Connection of Alpha Miner equipment to additional equipment in a manner likely to cause fluctuations in voltage supply;

  • Use of Power Supply Unit not certified in accordance with requirements of IECEE CB Scheme by one of the National Certification Bodies (NCB)

  • Use of power supply designed for air operation in immersion cooling

  • Damage caused by lightning or voltage surges;

  • Evidence of water damage and/or over exposure to heat and or flame;

  • Forcing Equipment to run at peak performance (not operational performance) for extended time;

  • Overclocking over the particular power supply specifications, as well as  any and all other modifications to hardware, BIOS settings, or software; and

  • Any other cause that does not relate to an Equipment defect in materials or workmanship.

 

Also excluded from this warranty are counterfeit Equipment; that is, Equipment that Alpha Miner, at its sole discretion, determines were not manufactured by Alpha Miner or for it  by any of its authorized manufacturing partners.

For all repairs or RMA, within warranty or not, the customer must return the defective equipment at his/her own expense after opening a support ticket with Alpha Miner warranty support division and attempted troubleshooting. Alpha Miner will cover return shipping cost when shipping a replacement unit within the warranty period. Please, contact Support for addresses and contact details of authorized warranty repair centers.

Limitation of Liability.

ALPHA MINER’s liability with regard to its equipment shall BE limited to the remedies provided herein and it is expressly agreed to and understood that ALPHA MINER SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA (WHETHER DIRECT OR INDIRECT), OR LOSS FOR BREACH OF ANY EXPRESS OR IMPLIED WARRANTY ON ALPHA MINER EQUIPMENT EVEN IF ALPHA MINER HAS BEEN ADVISED OF OR IS AWARE  OF THE POSSIBILITY OF SUCH DAMAGES.

Some local laws do not allow the exclusion or limitation of special, indirect, incidental or consequential damages, so this limitation or exclusion may not apply in your jurisdiction.

Exclusion of Implied Warranties.

EXCEPT AS PROHIBITED BY APPLICABLE LAW, ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE ON THIS HARDWARE PRODUCT IS EXPRESSLY DISCLAIMED.

Some local laws do not allow limitations on how long an implied warranty may last, so this limitation may not apply in your jurisdiction.

Data Recovery.

Without limiting any exclusions of Alpha Miner’s liability as provided for herein, in the event of data loss while using Alpha Miner equipment, Alpha Miner is not responsible for backing up or recovering any data that you may have lost.

National Statutory Rights.

Consumers may have legal rights under applicable national legislation governing the sale of consumer goods.

No Other Warranties.

No Alpha Miner employee, dealer, representative or agent is authorized to make any modification, extension, or addition to this warranty.

Special Warranty Period in the European Union.

In the European Union, the minimum warranty period provided by an authorized retailer is two (2) years. The minimum warranty period provided by a reseller for refurbished Equipment is one (1) year. This exception to the Alpha Miner warranty is limited by the timing and notification requirements of European Directive on certain aspects of the sale of consumer goods and associated guarantees (1999/44/EC) as well as European Directive (2011/83/EU), related to distance selling. However, Alpha Miner is not located in EU, doesn't keep stock in EU, does not sell products retail, doesn't have any official EU distributors, doesn't aim to sell to EU markets, and customers from EU are subject to Alpha Miner standard warranty terms.

How to Make a Warranty Claim.

Before submitting a warranty claim, we suggest you contact our technical support group or visit AlphaMiner.io and review the support section for technical assistance. A simple fix for your problem may be found there.

Valid warranty claims should be processed through your point of purchase during the first thirty (30) days immediately following purchase. This period may vary depending on where you purchased your Equipment; please verify the return policy with your retailer. Any warranty claims that cannot be processed through your original point of purchase should be addressed directly to Alpha Miner. Our customer service contact information can be found on the web at www.AlphaMiner.io/aboutus/support or in the warranty documentation included with your equipment.

Returning Your Product.

In the event that you need to return your Alpha Miner Equipment for repair or replacement, Alpha Miner will, once contacted, provide you with a Return Merchandise Authorization Number (RMA#) as well as return instructions. Do not return your Equipment without prior approval from Alpha Miner. Any Equipment returned without a valid, unique RMA# will be refused and returned to the sender at the sender’s expense. To avoid problems at the time of receipt, clearly write your RMA# on the outside of the package and include a copy of your RMA confirmation e-mail within the package containing your equipment.

Request a Return Material Authorization Number (RMA#).

Please follow these steps to obtain an RMA number:

  • Submit an RMA# request online at: sales@alphaminer.io

    • A legible copy of a valid proof of purchase is required for RMA processing (i.e. receipt, itemized invoice).

  • For business-to-business (B2B) and direct customers of Alpha Miner:

    • RMA credit value is based on the current published price list or lowest invoice value within 90 days of the day of the claim, whichever is lower

Please Note:

  • If equipment was purchased as a kit and/or bundle, then the whole kit and/or bundle must be returned for warranty replacement and the lot codes on each module returned as a kit must be identical.

RMA Return Addresses.

At different times we may have various RMA receiving and repair centers worldwide. Your RMA confirmation will specify the specific return address you must use when sending your RMA package. This will be your standard return location and should not be changed without prior approval from Alpha Miner. Any packages received at an unauthorized location may be refused and returned to the sender at the sender’s expense.

Products Lost or Damaged During Transit.

The original packaging material should be used to pack the Equipment for return; if the original packaging is not available, you should use packing materials that provide the same or greater protection to the equipment. All packages that arrive with any external damage or appear inadequately packed will be refused and returned to the sender at the sender’s expense. Alpha Miner is not responsible for damage incurred during shipping to our RMA receiving locations.

You should select a return shipping method that provides tracking information and procurement of insurance via the carrier of your choice is advised. Alpha Miner is not responsible for lost or misdirected packages.

RMA Processing.

  • Alpha Miner will perform a visual inspection of the package before acceptance to ensure there was no visible damage during transit which could affect the equipment being returned.

  • All equipment received will go through individual visual inspection to ensure the Equipment are genuine Alpha Miner Equipment with all applicable labels intact and free of physical damage/abuse.

  • The RMA#, which should be noted on the outside of the package, must be identical to the RMA# issued via email confirmation.

  • Packages with damage or that do not have a valid, unique RMA# clearly marked on the exterior, will be returned to sender at the sender’s expense.

  • Counterfeit Equipment, or Equipment that clearly fit the warranty exclusions listed above, will be returned to sender at the sender’s expense.

  • After inspection, and confirmation of the requirements listed herein, the equipment will be confirmed as received and processing will begin.

  • Typical Processing Times:

    • 10 to 30 business days for your replacement to be processed or for a credit to be applied to your account.

    • 30 to 45 business days for your replacement equipment to be shipped

    • If a pro-rated refund is to be provided, 30 business days for a refund to be processed. Refunds are issued in the same form the payment for the Equipment was made or other form at Alpha Miner discretion.

Process Times Subject to Change.

Warranty process times are subject to changes and the estimates provided above are for example only. Alpha Miner reserves the right to change and or modify the warranty process times for Equipment covered under this warranty at any time.

Alpha Miner Warranty Periods.

Effective October 28th, 2020, all new Alpha Miner products come with a 6-months warranty unless specifed otherwise. Warranty period starts once the product is shipped to the original buyer.
